James Comey files case against House Republicans to stop subpoena

Former FBI Director James Comey has asked a USA court to quash House Republicans' subpoena for his testimony, saying he wants to testify in public rather than behind closed doors.

"Mr. Comey asks this court's intervention not to avoid giving testimony but to prevent the Joint Committee from using the pretext of a closed interview to peddle a distorted, partisan political narrative about the Clinton and Russian investigations through selective leaks", the court documents read.

The November 21 congressional subpoena ordering Comey to appear for a closed-door deposition on December 3 was issued as part of an ongoing joint investigation by the House Judiciary Committee and House Oversight Committee. "Leaks are counterproductive whether Jim Comey is doing it, whether the Federal Bureau of Investigation is doing it, or whether Congress is doing it".

In a Monday interview with CNN's Erin Burnett on "Erin Burnett OutFront", Goodlatte rejected Comey's proposition for a public hearing, calling a it "not an appropriate forum" because it could reveal investigative details to other potential witnesses.

U.S. District Judge Trevor McFadden scheduled a hearing for Friday afternoon in Washington, D.C.

"James Comey is going to court to try to squash the House subpoena".

He previously worked in the Canberra press gallery and recently finished a Masters of Journalism at Columbia University in NY . During the campaign, Cohen acted as Trump's point person in an attempt to build the Trump development in Moscow.

"The subpoena, which calls for a closed, non-public deposition of Mr. Comey, exceeds a proper legislative objective, is issued in violation of House rules, and unduly prejudices and harasses the witness", Comey's legal team argued in their lawsuit filed on Thursday.

James Comey's attorneys have raised a concern that Republicans had "abused their powers with selective leaks" of information to succeed their political agenda and further said, "by doing so, lawmakers had "unfairly prejudiced" prior witnesses".

The Republican House leaders on the two committees, Trey Gowdy and Bob Goodlatte, and their general counsel have said it is within House rules to require a private deposition and that the subject matter is of importance to the country. He says he is a "victim" of Congress' "unauthorized and abusive tactics".

Pavlich said Comey's demand is "enraging", pointing out that regular civilians don't get to negotiate terms if they are subpoenaed by Congress.

"It appears Mr. Comey believes he deserves special treatment, as he is the only witness refusing to either appear voluntarily or comply with a subpoena". He was subpoenaed to appear next week.
