Homeless man sues couple who raised N145m to help him

A USA couple who raised more than US$400,000 (NZ$605,000) for a homeless man after he used his last US$20 to fill up the petrol tank of a stranded motorist in Philadelphia must now turn over what's left of the cash.

After a New Jersey couple raised more than $400,000 for a homeless veteran, and after allegations that they refused to give it all to him, a judge has ordered the couple to turn over the remaining money.

For their part, McClure and D'Amico deny wrongdoing and say that Bobbitt has already accessed around half the donated money, but they are now reluctant to give him any more large sums.

The case went to a New Jersey court on Thursday, where a judge ruled the couple needs to provide a full accounting of where the money has gone and said until then the remaining money needs to be turned over to Bobbitt's legal team and kept in a trust.

The money will be transferred to an account controlled by Cozen O'Connor PC, Bobbitt's pro bono attorneys. It calls for a clear accounting of all the donations to the GoFundMe account and requests appointing a guardian ad litem, a person assigned to advocate for someone who is unable to represent themselves due to mental illness or age.

McClure had run out of gas on Interstate 95 in Philadelphia - and Bobbitt walked to a service station and spent $20 of his own money to buy her gas.

More than 14,000 people have made donations.

After her story went viral, McClure set up a GoFundMe for Bobbitt that she said was meant to help buy the man a vehicle and get him a home. They say they've been leery about giving him large sums of money because they're anxious he'll buy drugs.

Bobbitt, a homeless man, had used his last US$20 to fill up the petrol tank of a stranded motorist in Philadelphia.

But, their relationship soured when Bobbitt insisted that the couple had not handed over all the cash raised for him.

Mr Bobbitt's lawyers say that the couple have been living the high life, splashing out on a BMW, lavish holidays and generally "living a lifestyle they could not afford" using the fund as "their personal piggy bank". McClure's and D'Amico's attorney said they had provided Bobbitt with more than $200,000, WPVI and KYW reported.

About $150,000, Mr D'Amico told NBC on Monday.

"I had to ask them for everything in the beginning", Bobbitt said, according to WPVI.

Bobbitt's lawyer said, "We're filing an injunction to enjoin them from doing anything with the money other than delivering it to us or paying Johnny Bobbitt".

They are now preparing the accounting that will "show where the money went", Badway said. They told host Megyn Kelly they stopped giving Bobbitts money because he would spend it on drugs.
